1. Our Business Model
Capital Link provides information, processes partnership applications/referrals,
Capital Link operates as a referral and partnership platform. We connect Australian businesses (merchants) with merchant facility (EFTPOS/POS) and merchant capital (business funding) solutions through our network of partners.
What we do:
- We receive referrals from aggregators, brokers, and financial institutions who introduce their business clients to us.
- We then assess, onboard, and support those merchants directly.
- We pay referral fees or commissions to our partners for successful introductions.
What we do NOT do:
- We are not a lender. We do not provide direct loans or advance funds to merchants from our own balance sheet.
- We are not a financial advisor. We do not provide personal or corporate financial advice.
- We do not hold an Australian Credit Licence (ACL) nor do we act as a credit intermediary. Our merchant capital product is a funding solution based on future card sales, not a regulated credit product.
- We do not charge merchants or partners any upfront fees.

3. Partner Referrals and Commissions
If you are a registered partner (aggregator, broker, or financial institution):
- You may submit merchant referrals to us via our Website, email, or other agreed channels.
- All referrals are subject to our acceptance and the merchant meeting our eligibility criteria.
- Commission structures are confidential and communicated separately to approved partners. These Terms do not form a commission agreement.
- We reserve the right to modify or discontinue commission programs with prior notice to active partners.
- You must not make any representations to merchants about expected funding amounts, approval certainty, or commission rates unless expressly authorised by us in writing.
4. Eligibility and User Conduct
By using this Website or submitting a referral, you represent that:
- You are at least 18 years old and have the legal capacity to enter into these Terms.
- If you are acting on behalf of a business or organisation, you have the authority to bind that entity to these Terms.
- Any information you provide (including merchant details) is accurate and complete to the best of your knowledge.
You agree not to:
- Submit fraudulent, false, or misleading referral information.
- Impersonate any person or entity, or provide false information via our enquiry or partnership forms.
- Attempt to disrupt, damage, or interfere with the security or proper working of the Website.
- Use the Website for any unlawful purpose or in breach of any applicable Australian laws, including the Competition and Consumer Act 2010 (Cth) and the Privacy Act 1988 (Cth).
